By booking travel products offered by our company, the customer is deemed to have read, understood, and accepted the following terms and conditions. In the following terms, “Company” refers to PHOTOFLY TRAVEL SDN BHD.

1. Booking & Payment

1.1 Deposit & Balance Payment

  • A deposit is required upon booking to secure a spot.
  • The balance must be paid within the timeframe specified by the Company, and no later than 30 days before departure.
  • Failure to make timely payment allows the Company to cancel the booking and forfeit the deposit.

1.2 Free Independent Traveler (FIT)

  • After confirmation, any changes will incur a modification fee of RM150 per person per change.
  • No changes are allowed within 30 days before departure.
  • Any itinerary changes must comply with airline and service provider terms and may incur additional costs.
  • Any request for an early or extended return must be arranged at the traveler’s own expense and comply with airline policies.
  • Changing the entire booking is considered a cancellation, and the cancellation policy (see 2.1) applies.

1.3 Group Tours

  • After confirmation, no itinerary changes are allowed.
  • Individual members wishing to return early or extend their stay must comply with airline and operator policies.
  • Changing the entire booking is considered a cancellation, and the cancellation policy (see 2.2) applies.

2. Cancellation Policy

2.1 Free Independent Traveler (FIT)

  • Cancellations must be submitted in writing; verbal cancellations are not accepted.
  • Cancellation fees:
    • 30 days or more before departure: Deposit is non-refundable.
    • 15-29 days before departure: 70% of the tour fee is non-refundable.
    • Within 14 days before departure: 100% of the tour fee is non-refundable.
  • Any non-refundable expenses, such as paid air tickets, name-registered train tickets, or other pre-booked items, will not be refunded.

2.2 Group Tours

Before Group Formation
  • The full deposit can be transferred to another tour or refunded after deducting an RM150 administrative fee.
After Group Formation
  • If a replacement traveler is found or if the Company successfully resells the spot, the traveler may transfer to another tour or receive a refund after deducting an RM150 administrative fee.
  • If no replacement is found, the following cancellation fees apply:
    • 30 days or more before departure: Deposit is non-refundable.
    • 15-29 days before departure: 70% of the tour fee is non-refundable.
    • Within 14 days before departure: 100% of the tour fee is non-refundable.

2.3 Private Group Tours

  • Travelers may find their own replacements and transfer the booking or request a refund (after deducting an RM150 administrative fee).
  • Tour prices are based on the original number of participants; cancellations may lead to additional costs for remaining members.
  • If cancellations reduce the group size below the required minimum, the Company reserves the right to:
    • Cancel the tour and provide a refund or transfer option.
    • Convert the tour into a public tour and notify all members of the changes.

2.4 Other Cancellation Cases

  • If a visa application is rejected, a refund may be requested, subject to case evaluation.
  • In the event of unforeseen circumstances or force majeure (e.g., weather, pandemics, strikes), the Company reserves the right to modify or cancel the itinerary.

3. Travel Responsibilities

3.1 Traveler Responsibilities

  • Travelers are responsible for additional costs caused by unforeseen events (e.g., weather, political instability).
  • Travelers must hold a valid passport (minimum 6 months validity) and obtain necessary visas and vaccinations as required by the destination.
  • The Company is not responsible if a traveler is denied entry due to carrying illegal items or other personal reasons.

3.2 Company Responsibilities

  • The Company advises travelers on required travel documents and may assist with visa applications (but does not guarantee approval).
  • If the Company cancels a tour, a full refund or alternative tour will be offered.

4. Travel Information & Pricing

  • Prices are subject to fluctuations due to exchange rates, fuel surcharges, taxes, etc. The Company reserves the right to adjust prices accordingly.
  • Optional self-paid activities are not part of the contract, and the Company holds no responsibility for them.
  • Tour package includes:
    • Accommodation (standard twin-sharing rooms; single travelers must pay a single supplement).
    • Meals, transport, entrance fees, and activities specified in the itinerary.
  • Tour package does not include:
    • Personal expenses (e.g., laundry, additional meals, shopping).
    • Travel insurance (highly recommended for all travelers).

5. Other Terms

5.1 Baggage

  • Checked baggage allowance follows airline regulations; insurance is recommended.

5.2 Refunds for Unused Services

  • No refunds for unused services (e.g., flights, hotels, meals) due to personal reasons.
  • Travelers who fail to show up on the departure date will not be refunded.

5.3 Complaints Handling

  • Any issues during the trip should be reported immediately to the tour leader or service provider.
  • Written complaints must be submitted within 14 days after the tour, and the Company will process them within 14 days.

5.4 Entry Denial

  • If a traveler is denied entry due to personal reasons, no refunds or compensation will be provided.

5.5 Photography, Image Usage, and Delivery Policy

  • Image Usage Authorization: The Company reserves the right to use photos and videos captured by our photographers during the tour for lawful promotional purposes, including brand marketing, social media content, and commercial advertising. If you do not consent to the public use of your personal images, please notify us in advance prior to the commencement of the tour. We will fully respect and protect your privacy.

  • Post-Processing Standards: To ensure visual quality, all photos delivered to clients will undergo professional overall post-processing (including exposure adjustment, color correction, and stylistic color grading). Please note that the final deliverables do not include deep retouching services, such as facial or body modifications, or the removal of background objects.

  • Provision of Original Files: To maintain the artistic integrity of our photography and uphold our brand’s visual standards, unedited original files (including but not limited to RAW files and unedited JPEG files) will not be provided under any circumstances. We kindly ask for your understanding.

5.6 Personal Data Protection

  • The Company ensures the confidentiality of customers’ personal data, which will only be used for travel arrangements and not disclosed to unrelated third parties.

5.7 Code of Conduct

 

  • In the event that any participant engages in disruptive behavior, including but not limited to causing trouble, physical altercations, verbal abuse towards fellow travelers or the tour leader, emotional outbursts, or any conduct deemed harmful to the harmony and safety of the group, The Company reserves the right to remove the participant from the tour without any refund or compensation. All subsequent expenses, including accommodation, meals, and transportation, shall be borne solely by the individual. The Company also reserves the right to take legal action against any participant whose conduct causes damage, loss, or harm to the company, its representatives, or other participants.

5.8 Compensation Policy

 

  • Any requests for refunds or compensation arising during the trip, once deemed valid by the company, will be processed and completed within a 90-day payment term.

6. Disclaimer

  • PHOTOFLY TRAVEL SDN BHD reserves the right to amend these terms and conditions at any time without prior notice. The latest version can be found on the Company’s website or by contacting us. The Company retains final interpretation rights over these terms.
